Law No 82/2002
Concerning Protection of Intellectual Property Rights
Article ( 1 )
Provisions of this Law shall be enforced in respect of
Protection of Intellectual Property.
Article ( 2 )
The following laws shall be cancelled :
( A ) Law No. 57 of 1939 concerning trade mark and trade
description.
( B ) Law No. 132 of 1949 concerning Patents of invention &
Designs & Industrial Models except stipulations concerned
Patents of Chemical products related to foodstuffs and
chemical pharmaceutical products which shall be cancelled as
of 1 January 2005.
( C ) Law No. 354 of 1954 concerning copyright.
Any provisions contrary to the stipulations of this law shall
be cancelled.
Article ( 3 )
The Cabinet of Ministers shall issue the Implementing
Regulations within a period not exceeding one month from the
date of this law. The concerned Ministers, each within the
limits of his competence, shall issue the necessary Decrees to
enforce the provisions of this law
The Ministers, each within his competence, shall take the
measures necessary for protection of public health and
nutrition , or the development of vital sectors in social,
economic and technological fields within the limits of the
attached Law.
The Ministers, each within his competence, shall take the
necessary procedures within the context of the present Law to
prevent Intellectual Property owners from abusing this
property. |
